INTRODUCTION

This Policy explains what “Personal Information” is, what information Bumble Bee may collect, its sources, why it is collected, how it is used, and how it is protected.

Bumble Bee uses five web domains and refers to them in this Policy as the “Websites.”

Your use of the Web Sites or Applications constitutes your agreement to and acceptance of this Policy and your consent to the practices it describes.
Bumble Bee updates this Policy every year. This version became effective on July 20, 2023.

DEFINITIONS

“PERSONAL INFORMATION”

Personal Information is information that identifies a particular person. This includes – for example – names, addresses, email and IP addresses, telephone numbers, birth dates, and security question answers.

“SENSITIVE PERSONAL INFORMATION”

Under California law, “Sensitive Personal Information” means Personal Information that reveals aspects of a person’s identity that is considered particularly private, including – for purposes of this Policy – information collected and analyzed concerning a consumer’s health.

Bumble Bee may collect Personal Information from consumers for addressing questions and concerns about products.

Bumble Bee may collect IP addresses of visitors to its websites for security in case of cyberattack.  This information is not used unless a security event occurs.

RETENTION OF PERSONAL INFORMATION FROM CONSUMERS

Bumble Bee retains Personal Information from consumers for addressing questions and concerns about products for six years.  Bumble Bee retains Personal Information relating to legal or litigated claims for ten years.

Bumble Bee may obtain Sensitive Personal Information from consumers who voluntarily submit their health information regarding a product claim.

Bumble Bee may collect Sensitive Personal Information in the form of a consumer’s voluntarily submitted health information for addressing questions and concerns about products.

RETENTION OF SENSITIVE PERSONAL INFORMATION FROM CONSUMERS

Bumble Bee retains Sensitive Personal Information from consumers for addressing questions and concerns about products for six years.

Bumble Bee may collect Personal Information from employees of other businesses for:

  • Purchasing raw materials and ingredients
  • Securing services
  • Selling Bumble Bee products
  • Executing contracts

RETENTION OF PERSONAL INFORMATION FROM OTHER BUSINESSES

Bumble Bee retains Personal Information from other Businesses for ten years.

Bumble Bee retains Personal Information relating to contracts for ten years after the expiration or termination of a contract.

SALE OF PERSONAL INFORMATION

Bumble Bee does not sell for value any Personal Information.

EMPLOYEES AND APPLICANTS FOR EMPLOYMENT

Bumble Bee may obtain Personal Information – as well as Sensitive Personal Information as defined under California law – from employees and applicants for employment.  This is covered under Bumble Bee’s Privacy Policy for Team Members and Applicants for Employment.

DISCLOSURES OF PERSONAL INFORMATION AND SENSITIVE PERSONAL INFORMATION

Bumble Bee may disclose Personal Information and a consumer’s voluntarily submitted Sensitive Personal Information regarding product claims to the third-party vendor that it uses to address consumer questions and concerns.

RETENTION OF PERSONAL INFORMATION AND SENSITIVE PERSONAL INFORMATION

Bumble Bee retains Personal Information in accordance with legal and policy requirements in line with its record retention schedule.   Bumble Bee only collects, processes, and retains the minimum necessary personal information that is required for the purposes for which it was collected.

Bumble Bee retains Personal Information and Sensitive Personal Information regarding consumer critical or litigated claims for ten years, and six years for all others.

Bumble Bee maintains Business to Business Personal Information for a maximum of ten years.

Bumble Bee retains IP addresses of visitors to its websites through access logs for security purposes for approximately one week.

HANDLING PERSONAL INFORMATION IN THE EVENT BUMBLE BEE OR ANY OF ITS SUBSIDIARIES IS SOLD TO, OR ACQUIRED BY A THIRD PARTY

If Bumble Bee or any of its subsidiaries is sold or acquired by a third party (including through an asset sale, merger, or similar transaction), all Bumble Bee data assets will be transferred to, and become the property of, the acquiring party.  That party will be subject to any consumer conditions regarding data.

THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT

Bumble Bee is committed to providing a safe Internet environment for users and their children. Although Bumble Bee does not actively promote the Websites to children under 18 years of age, children and young adults are able to explore them.

Bumble Bee does not knowingly collect information from children.

Bumble Bee recognizes the unique issues involving the protection of children’s privacy over the Internet.  If Bumble Bee decides to actively promote the Websites to children, they will be designed to comply with the requirements of the Children’s Online Privacy Protection Act (COPPA), and the Children’s Advertising Review Unit (CARU) guidelines for websites gathering identifiable information from children under age 13.  Consistent with these requirements and guidelines, and provided that Bumble Bee has been given accurate information by a child when asked, Bumble Bee will NOT:

  • Collect personally identifiable off-line contact information without prior parental consent;
  • Distribute to third parties any personally identifiable information without prior parental consent;
  • Entice children by the prospect of a special game, prize or other activity, to divulge more information than is needed to participate in the activity;
  • Enable children to publicly post or otherwise distribute personally identifiable contact information without prior parental consent;
  • Use or disclose online contact information without prior parental consent or parental notification, which will include an opportunity for the parent to prevent use of the information and participation in the activity. Without prior parental consent, online information will only be used to respond directly to the child’s request and will not be used for other purposes without prior parental consent.

Bumble Bee urges parents to spend time with their children on the Websites to learn more Bumble Bee products and recipes.  Although Bumble Bee will do all it can to ensure children’s privacy and safety, informed parents are the best protectors of their children.

Parents can always ask to review any Personal Information about their child that may have been collected at one of the Websites, have Bumble Bee delete any such Personal Information, and instruct Bumble Bee not to collect or use any Personal Information about their child in the future by contacting Bumble Bee through one of the options found at the end of this Policy.

PROTECTING PERSONAL INFORMATION AND SENSITIVE PERSONAL INFORMATION

Bumble Bee has in place procedural, technical, and administrative measures to safeguard information.

As a matter of policy, Bumble Bee does not disclose details regarding security measures because they could be used by those who intend harm or violate the law.

While Bumble Bee takes every reasonable step to securely maintain all information, no safeguards or standards are guaranteed to provide 100% security.  Bumble Bee encourages users to use appropriate self-protection measures and practice safe browsing on all websites.

Finally, some who intend harm may attempt to use the Bumble Bee brand to create fake websites, send fake texts or emails, and conduct other activities to commit fraud or attempt to breach consumers’ security.  If a user receives anything with the Bumble Bee brand that seems suspicious, please contact Bumble Bee using one of the methods described in the “CONTACT BUMBLE BEE” section at the end of this Policy.

PRIVACY RIGHTS UNDER CALIFORNIA LAW

General disclosures to consumers

Bumble Bee is based in California.  Under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), unless legally exempted, California consumers have the right to request a business that collects Personal Information about them to disclose free of charge:

  • The categories of Personal Information a business has collected about them over the last 12-months;
  • The categories of sources from which the Personal Information is collected;
  • The categories of Personal Information that a business sold or disclosed for a business purpose about them;
  • The business or commercial purpose for collecting or selling Personal Information;
  • The categories of third parties with whom a business shares Personal Information;
  • The specific pieces of Personal Information a business has collected about them.

Disclosure of information sold or disclosed for a business purpose

Consumers have the right to request that a business that sells their Personal Information, or that discloses it for a business purpose, disclose to them:

  • The categories of personal information that the business collected about them;
  • The categories of personal information that the business disclosed about them for a business purpose over the last 12 months.

 

Deletion of Personal Information or sensitive personal information

Consumers also have the right to request that the business delete any Personal Information about them which a business has collected from them – unless legally exempted.  For example, this right does not apply where the business needs to retain the personal information to:

  • Provide goods or services to the consumer;
  • Detect or resolve issues security or technical issues;
  • Conduct public interest research;
  • Safeguard the right to free speech;
  • Conduct internal activity that a consumer would reasonably expect; or
  • Comply with the law.

Correction of inaccurate information

Consumers have the right to request correction of inaccurate personal information collected by a business.

California “Do Not Track” Disclosure

Because Bumble Bee does not track users of its Websites over time and across third party websites to provide targeted advertising, Bumble Bee does not respond to “Do Not Track” requests.

Non-discrimination for exercising CCPA and CPRA rights

A business may not discriminate against a consumer because the consumer exercised any of their rights under the CCPA or CPRA.  For example, a business may not:

  • Deny or threaten to deny the consumer goods or services;
  • Charge the consumer different prices for goods or services by denying benefits or charging more for them, or threaten to do so; or
  • Provide or threaten to provide the consumer with a different level or quality of goods or services.

How to exercise rights under California law

Consumers may request the Personal Information and Sensitive Personal Information or the deletion of that information by submitting a verifiable request (meaning one that a business can reasonably verify) using one of the methods described in the “CONTACT US” section.

Only the consumer or an authorized agent of the consumer may make a verifiable request for information.  A consumer may also make a verifiable request for that consumer’s minor children.

Consumers may submit requests twice within 12 months.

Within ten business days of receiving a request, Bumble Bee will confirm receipt and provide information about how the request will be processed, including the verification process and when the response should be expected.

Bumble Bee will conduct a search of records for responsive information, and then respond to requests within 45 days at no cost to the requestor.

USE OF INFORMATION TECHNOLOGIES – “COOKIES”

“Cookies” are small text files that are used to store small pieces of information. When a website is loaded onto a browser, cookies are stored on a website user’s device. They can make websites function correctly, make them more secure, provide a better user experience, and analyze how they perform so that they may be improved.

Bumble Bee allows users to accept or reject cookies from its websites by choosing options presented on the Cookie Banner that appears upon access of its websites.

The cookies that Bumble Bee uses do not collect users’ personally identifiable information.

INTERNATIONAL TRANSFER OF INFORMATION

Bumble Bee is located in the U.S., and this policy follows U.S. law – particularly California law.  If Bumble Bee websites are accessed from outside of the U.S., information collected may be transferred to, processed, stored, and used in the U.S., where data protection laws may differ from that of a user.  Use of Bumble Bee websites is presumed to be consent to transfer to, processing, usage, sharing, and storage in the U.S.
